OPPOSE: AB 24 / SB 57 - Forcing Sheriffs to do ICE's Bidding

 OPPOSE

From ACLU WISCONSIN: This bill pushes local law enforcement into harmful roles they were never meant to play — tools of mass deportation. If law enforcement refuses to do ICE's bidding, this law would strip away funding for essential services in our counties.

Specifically, this bill would force local sheriffs to: 

  1. Request proof of the citizenship status of anyone in jail alleged to have committed any felony, and report anyone to ICE who fails to have ready access to an acceptable form of proof or anyone who invokes their Fifth Amendment right to remain silent; and
  2. Without a warrant signed by a judge, hold anyone accused of a felony in jail for 48 hours after they should have otherwise been released if ICE requests to pick them up.

SUPPORT: Driver's Licenses for All

Since 2007, the implementation of the REAL ID Act in Wisconsin has limited driver’s licenses to American citizens. Since then, the struggle to restore state driver’s licenses and state IDs for immigrants has been ongoing nationally and in Wisconsin. Currently, 19 states have restored the rights of immigrants to obtain driver’s licenses.


Under the current administration, Immigration and Customs Enforcement (ICE) has targeted Wisconsin residents who have been stopped for driving without a license. Using court records related to these minor traffic infractions, ICE has separated hundreds of Wisconsin families. Restoring access to driver licenses for immigrant residents will reduce discrimination and keep families together.

Immigrants in Wisconsin are taxpayers, employers, and workers who have made great contributions to the state’s economy. With many jobs requiring driver’s licenses or being outside the reach of public transit, job prospects are severely limited for these individuals. Lack of workers already severely affects the state’s dairy industry, which relies heavily on immigrant workers. Being a welcoming, pro-immigrant state and restoring access to driver licenses is essential to addressing the state’s labor shortage and making Wisconsin’s economy thrive.

The lack of access to driver’s licenses by undocumented immigrants has placed an undue burden on Wisconsin residents who have otherwise integrated themselves culturally and economically into the community. Undocumented Wisconsin residents have expanded the state’s workforce; they have contributed millions of dollars in tax revenue; and they have created safe, stable communities by putting down roots as long-time residents. 


Driver’s licenses for all must be safely pursued with strong privacy protections to prevent information shared during the license application process from being transmitted to Immigration and Customs Enforcement (ICE). I am asking you to SUPPORT restoring access to driver’s licenses for every eligible Wisconsinite to make our communities safer and welcoming for all.

OPPOSE: AB 163: Stricter BadgerCare Eligibility Requirements

 OPPOSE

From ACLU WISCONSIN: Under current law, BadgerCare Plus provides critical health care coverage to certain children, pregnant people, parents and caretaker relatives, former foster care youth, and adults aged 19 to 64 who are not receiving Medicare and who do not have dependent children if they meet certain financial criteria.

This bill would prohibit the Department of Health Services (DHS) from automatically renewing health care benefits for those covered by BadgerCare Plus, would require verification of eligibility every six months (instead of annually), not allow DHS to use pre-populated forms, and would kick people off BadgerCare Plus for six months if they do not report a change that may impact their eligibility. 

The administrative burdens imposed by this bill and risk of disenrollment would disproportionately fall on Black, Indigenous and other people of color, as well as people with disabilities —exacerbating health inequities for the most marginalized Wisconsinites.

This bill adds unnecessary barriers to low-income Wisconsin residents who rely on BadgerCare for healthcare coverage. It will exacerbate health inequities for Wisconsinites who are the most marginalized in our communities.

Every person deserves access to healthcare. The recent cuts to Medicaid by the Trump administration are cruel and will cause suffering. I request that [REPRESENTATIVE] join me in making sure this bill DOES NOT get passed so we do not add to the loss of healthcare coverage in Wisconsin.

SUPPORT: AB 207 / SB 205: Referendum Explainers

From ACLU WISCONSIN: In recent years, Wisconsin voters have seen several statewide referendum questions proposing amendments to the state constitution on their ballots. These confusingly worded ballot questions have been used by the majority party in the state legislature to bypass the governor’s veto when proposing state constitutional amendments.

This bill would institute a plain language summary for referenda that must be posted at polling places, posted on myvote.wi.gov, and included with absentee ballots provided to voters.
